Eddie Harwood files formal misconduct complaint against Drew Reisinger, Holly Jones and Brownie Newman.

 

My name is Eddie Harwood and I live in Barnardsville.

I’d like to bring before this board a formal misconduct complaint against the Buncombe County Register of Deeds, Drew Reisinger.

On February 12 of this year, the Register of Deeds closed that office at approximately lunchtime, and again on February 13 for a full day due to inclement weather.  

As a former Buncombe County employee and lifelong resident, I have never known only one office to close.

When inquiring about this, I understand that Mr. Reisinger took this action on his own, violating County policy and breaking North Carolina General Stature 161-8 “Attendance at Office.”

What this action did was take away the option of his employees to work and not use valuable vacation time or not get paidAll other County employees DID have to work.  If the tax office and DSS can open, so can the Register of Deeds.

This created an inequity with all 1,400 Buncombe County employees and requires compensation.  To right this wrong, it will cost Buncombe County Taxpayers between one-half and 1 Million dollars !!!!

I further understand that YOU, the Buncombe County Commissioners knew about this after the fact yet haven’t taken steps to address or take action, all at the dismay of employees who work for this county.

You all should be ashamed for not dealing with Mr. Reisinger, who by the way, was posted all over Facebook sledding with his friends while other County employees were working.

Additionally, I have a misconduct complaint against Commissioner Holly Jones for not recusing herself from voting on the County budget that included funds for the YWCA, for which she is a paid employee and has insight into the direction of these funds.  This action is in violation of North Carolina General Stature 14-234 and is unethical and self dealing.  

What we as citizens of Buncombe County see is a pattern of self dealing.  During his time on Asheville City Council, Brownie Newman, voted for funds for the company he works for, FLS Energy.  Even though he hasn’t done this with the County yet, it is an upsetting pattern that must not be tolerated.

Wrong is Wrong, and elected officials should be held to a high standard.  It’s about fairness for All, not just a select few.

Jeff Richardson, Asheville’s assistant city manager, said the city checked Anderson’s background, including his time in DeLand, and found he was the best man for the job.
The city used an 18-member committee to pare down a pool of 109 candidates from a nationwide search.

City Manager Apologizes For GPD Chief's E-mail, No Comment From Chief 
WITN tried to get the Greenville Police Chief's response to his recent controversial e-mail to the mayor about crime in downtown Greenville, but we were told he was unavailable Tuesday.
At Monday night's special meeting between Greenville's city council and the city manager, some voiced their concerns about the e-mail Police Chief Anderson sent to its members. He wrote about a fight in downtown Greenville Thursday that led to a shot being fired, but no one was hit. Anderson said in the e-mail the downtown situation is a "powder keg environment" and there needs to be leadership from the council to help prevent a dangerous situation. The tone of the e-mail offended some on the board, and the city manager even apologized. At -large city councilman Dennis Mitchell says he had never received an email from a city leader like this one.
"You want your different managers in the city to be able to talk frankly, but I think at some point it's counter productive and I think that's what the e-mail did," said Mitchell
Mayor Allen Thomas told us, he would like to put this issue behind them, so they can move on and deal with the city's business.

Undated Petition in protest of William Anderson

This is a petition to present to our city council in protest of Chief William Anderson of Greenville, NC. Chief William Anderson has not been an effective leader for our community. The crime rates have risen tremendously in the last 2 years since he has been in office. A growing hub of eastern NC for the past few years now, the proud citizens of Greenville are now reduced to fear of their own safety and are ashamed that our city has been publicized as having the 2nd highest spike in crime in the state. Our officers are unhappy working for him and his ridiculous rules. 

We do not blame Chief Anderson for the crimes being committed -- we blame his leadership for not properly handling them and for once again taking a city down the wrong path as far as officer morale. The time to take action is now before things get worse. We ask that a full investigation be done by an unbiased outside agency into the police department. We ask that they look into the accusations of police reports being purposely labeled incorrectly, officers being mistreated, the new policies he has implemented, mishandling of government funds and more. We urge this investigation to divulge into his past performance and accusations of corruption in both Deland, Fl and Elizabeth City, NC.

Deland Oks Severance Deal For Police Chief

DELAND -- The City Commission on Monday approved a resignation package for police Chief William Anderson, whose roughly three-year tenure was marked by controversy over what critics called a heavy-handed management style.

The separation agreement between the city and DeLand's first black police chief, who didn't attend Monday's special meeting, makes Anderson's resignation from his $70,366-per-year job effective Jan. 3.
The agreement stipulates that neither the city nor Anderson will make any "negative or disparaging statements" toward each other. Commissioners also agreed, in a 4-1 vote, to give Anderson a three-month severance package, plus he could be eligible to earn up to three more months of severance unless he gets a job during that period.

Maureen France, Anderson's most vocal opponent, cast the lone dissenting vote against the package. She said little through most of the meeting, even as Anderson's supporters chastised her for comments she made about Anderson in the past.

France nodded in agreement when Mayor Bob Apgar called for the community to come together in the wake of Anderson's resignation, which he said created an opportunity to "put the past behind us."

"I intend to seize that opportunity. I have no intention of playing the blame game," said Apgar, who also announced plans to create a task force to boost minority employment.

Apgar said he doesn't think the city has poor race relations but said, "We can do better."

Anderson supporters turned out for the meeting, saying he did great things for the city and the Police Department but he was unfairly criticized because he tried to transform an agency that's unaccustomed to change.

"DeLand is simply not ready" for a black police chief, said Charles Williams, a DeLand native and Anderson supporter. "We just refuse to move forward."

Anderson announced his resignation Friday, less than a month after France issued a statement calling for him to step down, citing "the declining morale, unrest and mismanagement that have plagued the department under Chief William Anderson."

France, whose husband is a lieutenant with the department, released the statement in the wake of a 22-page grievance filed by Cmdr. Randy Henderson, who complained, among other things, that Anderson had created an atmosphere of hostility.

Retired Altamonte Springs police Chief William Liquori, who has a reputation for turning around troubled police agencies, will serve as DeLand's interim chief after Anderson's departure and until the city hires a permanent leader, a process expected to take three or four months.

Liquori, who has 43 years of law-enforcement experience, will serve as the temporary assistant chief until Anderson's last day.

Buncombe County School Board STEM School History

This page is an attempt to raise awareness by documenting the Board Of Education meetings and their actions in regards to possible contamination issues. We have two large scale contamination sites in Buncombe that after many years show no signs of being resolved. I am hopeful that this page will assist in nipping in the bud any possible over exposure to students or employees at the site in question on Bingham Road. Reviewing the history in Buncombe County, the pattern has been to allow contamination exposure to fester with the wrongheaded approach that ignoring it, or passing the blame will make it go away. I am hopeful that with my documenting and spreading the word, that more people become aware and raise their voices in protest to putting people at risk, when there has been no real investigation into what was dumped, and where the underground plume is headed.

Buncombe School Board approves hazardous waste testing

In the August 2 meeting, the Buncombe County Board of Education approved testing for possible ground water contamination at their Bingham Rd. office site. According to documentation, Buncombe County Schools Superintendent Dr. Tony Baldwin received a letter from the North Carolina Department of Environmental and Natural Resources about the possible need for future testing.
The letter was dated February 8, 2012 and stated the possible need for testing a building located at 128 Bingham Rd. and 200 Bingham Rd., the old Square D plant and the old Champion Finishing Plant. These buildings are across the road from the Buncombe County Schools offices located at 175 Bingham Rd.
The letter indicated the question regarding testing was raised by a January 27, 2012 phone call from a Buncombe County School Board member. According to the letter, the school board member who called, stated that the two properties in question, 175 and 200 Bingham Rd. were to be converted from industrial facility space into classrooms. However, according to Board of Education Chairman Bob Rhinehart, the board has no intention of using either property for classrooms. 
Rhinehart said the Board is considering converting space in their current offices located at 175 Bingham Rd. for STEM classrooms. The letter also stated the caller inquired about possible environmental issues of the current offices located at 175 Bingham Rd.
The letter shows the Old Square D and Champion Finishing plant properties are listed as inactive hazardous sites. Rhinehart and Buncombe County Schools Communications Director Jan Blunt, said the sites were tested and the groundwater wells capped and closed in the 1990’s. These testing wells include one owned by Champion located on the property near the current Buncombe County Schools (BSC) offices.
Blunt said since Dr. Baldwin received the letter in February, they have been attempting to get the well on their property at 175 Bingham Rd. tested, but have been unable to get permission from the owner of the well. One email to Dr. Baldwin from BCS Maintenance Director Gregg Fox states, “The monitoring well sampling scheduled to take place today has been cancelled due to the party who installed the well (Champion’s) non response for access.”
Blunt said they have finally received permission from Champion to go ahead with testing and that DNR authorities will proceed with a groundwater test on August 8.
“After that we will know if we need additional testing,” said Blunt.
During the meeting, board members Pat Bryant, Chip Craig and Steven Sizemore all agreed that they would not go forward with classroom plans until thorough testing proved the building was completely safe.
“My wife has worked in this building for 17 years, said Bryant. “If the tests show any danger I would get her out and keep students out.”
Board member Lisa Baldwin brought up the possible contamination issue during the public comment session of the meeting. She said she spoke during public comment because the board comments had been taken off the agenda.
Rhinehart said he had received complaints about the board comments section of the agenda being repetitive and containing the same info every time. “If the board wants to put it back on the agenda they can do so,” he said.
Though Baldwin made a motion to ad a board comments period, the motion died for lack of a second.
During the meeting, the board also received a report regarding the 2012 ABC’s summary results showing: BCS rate high for growth, have two Schools of Excellence, fifteen Schools of Distinction and seventeen Schools of Progress. The board also approved receipt of a million dollar gift of a softball field for Enka High School, approved naming the circle drive at Black Mountain Primary School and approved a renewal of the Driver’s Education contract.
Dr. Baldwin reported that staff and faculty will return to schools on August 13 and students’ first day will be August 16.

Dear Dr. Baldwin:


On January 27, 2012, Division of Waste Management, Superfund Section’s Inactive Hazardous Sites Branch (IHSB) received a telephone call from a member of the school board regarding contamination in soil and groundwater at the former Square D plant at 128 Bingham Road.  The caller indicated that this property is currently owned by the Buncombe County Board of Education (BCBOE), which is using a building on the site for office space and planning to use the location for classrooms in the future,   This letter is to confirm that there has been a change in the planned future use of the Square D site from its previous use as an industrial facility to space that will be occupied by students. If this is correct, it will be necessary for IHSB to re-evaluate future environmental actions at this site, and the nearby former Champion Finishing site at 200 Bingham Road.  If this is not correct, please let me know immediately using one of the contact methods below.  
Initial investigation identified an additional site with documented contamination nearby, the former Champion Finishing plant at 200 Bingham road. In the week following this call, files for the Square D and Champion Finishing sites were obtained from Raleigh and are being reviewed.  The environmental consultants working on the referenced sites, and their clients, have been notified of a recent change in NCDENR staff assigned to these sites, and current contact information for all involved parties was obtained

The caller also inquired about possible environmental issues at 175 Bingham Road, also owned by BCBOE.  There is a potential for contaminants in groundwater to migrate from their original source onto nearby locations. IHSB will not be able to provide an answer regarding this specific location until a comprehensive review of all available documents has been completed.  It would be helpful in completing this sreview if you could provide information on the terms under which the BCBOE acquired the former Square D property, and current and planned future use of any former industrial buildings and parcels in the area that are owned by the BCBOE.  HSB will inform you when it has completed its review.

However, in the reports his lobbying expenses are nearly always $0. Possibly because the city was paying him to go over there and footing the bill and he could kill two birds with one stone?





At 4.13.13 meeting Newman proposed:"A "Buncombe County Energy Independence Initiative" proposed by Brownie Newman that would commit the county to reducing its carbon emissions by 2 percent per year until it reaches a total reduction of 80 percent."

At its August 2 meeting, the Buncombe County Board of Commissioners approved a measure that paves the way for Enka High School to install solar panels on its roof. The motion was necessary because in order for the Buncombe County Board of Education to lease the roof for a potential solar installation, Commissioners first had to determine that the property would not be otherwise needed by the county for the duration of the expected 20-year lease.
